How do we transfer from primary DPOA to alternate DPOA?

Just an update. We didn't need to transfer DPOA. Mom slipped and broke her hip, wound up in the hospital and now is in rehab. My brother and I decided that due to her being handicapped, and now this new condition as well as her mental condition, the safest place for her will be to continue on where she is currently. After checking out all the rehabs, we found one that provides terrific care for Alzheimer's individuals. Mom is not aware she is staying yet, but we will cross that bridge when we get there. As it turned out, we need to place her on Medicaid so we hired an attorney and my brother is doing a great job as mom's DPOA. Thank you everyone for your comments and suggestions with my question. It is so good to know others are out there experiencing or have experienced the same types of situation.

If the primary POA refuses to step down, you take him to court.

However...if sibling won't resign from primary (but needs to) and I move from alternate to primary to protect my parents and carry out their wishes properly...what should I do?

p.s. If it is financial doable I'd suggest that immediately after your brother resigns have a new DPOA drawn up naming you. That way it should be easier for you to be noted as the person in charge with your moms financial institutions and medical professionals.

Your brother needs to resign the position in writing to both your mother and the attorney who drew up the DPOA agreement.
