How do I protect a 90 year old from financial elder abuse by her daughter? Is a restraining order appropriate?

Thank you so much for all the advice. Without going into too much detail, my sister & her BF are longtime functioning drug addicts who very clever & manipulative. I think APS is a good place to start- hopefully they can help me sort it out. Thanks again!

If your mother is competent in the legal sense, she is entitled to do whatever she wants with her money. She can give it to a television evangelist or her youngest daughter, even if you think they are scamming her.

But if she is indeed being deceitfully exploited the agency set up to deal with that is Adult Protection Services. At her age and with her memory impairment she is a vulnerable adult. If you report your suspicions (with all the evidence you have) they will investigate.

Be aware, though, if they interview your mother and she says, "Oh I know that Youngest Daughter fibs a little to me, but I want to give her money now while I can see her enjoy it instead of leaving it to her in my will," they may not be able to do much.

Another option is to become her financial POA. Then you can help protest her assets. Would she agree to such an arrangement?

No, no power of attorney is set yet. Mother has mild memory issues but is being drained financially by my younger sister & conniving boyfriend who are deceiving her. Mother only has poor judgment & Im not sure what steps to take before serious damage is done to her estate. I thought maybe a restraining order against them might help?..

Cara, we need more information. Such as is the elder's daughter her Power of Attorney for financials? What type of abuse is happening? Who is telling you about this abuse? Does the elder have memory issues?
