My brother who is 64 became divorced with no place to live. I let him stay with me temporarily and he has had a stroke. Has diabetes and needs open heart surgery but is not stable enough to have surgery. They sent him home with me and I can’t take care of him… He only has Medicare and disability check. I am 66 and have health issues and work 12-hr days. Been trying for months to get him a low-income apartment, but waiting lists are two years long.

Does he need 24 hour care? Or is he able to take care of himself (is he ambulatory, can he prepare food and feed himself, shower and dress himself, take his diabetes medicine by himself)? I'm asking because it is not clear based on your post (if he does need 24 hour care, a low income apartment wouldn't be appropriate anyway). If he meets the requirements for a SNF (meaning he needs 24/7 care), contact your local Agency on Aging and request help getting him approved for nursing home Medicaid. Also, as others have said, if he does go back to the hospital at some point meet with the SW and case manager, let them know you can't take care of him anymore and ask for their assistance finding a facility for him.

Contact social services for your county and discuss options for him. Let them know you're not his legal guardian or PoA and don't wish to be. If he has another health incident that requires a trip to the ER, then do not go pick him up -- tell the discharge people that it's an "unsafe discharge". They'll pressure you a lot and maybe even make promised to help you... don't believe it. Do not go pick him up. The hospital social workers will take it from there and he'll get the help he needs.

Call your aoa or county social services. Or wait until his next er visit and just tell them you can’t care for him anymore, so unsafe discharge.
