I took care of my mother. My brother and I were criticized and accused of anything and everything. All nonsense. I, too, have Alzheimer's. I am my mothers's executor, however my wealthy side of the family is contesting that. Do you have any other atrocities that you are aware of that we face? I would like help, thank you.


I truly miss my mother and I am depressed, however I am not going to have them accuse me of anything and everything. So far Probate has it. She had a will however she made mistakes and it most likely will be set aside. My family are wealthy, I and my brother are not wealthy people. She passed away almost 9 months ago. Thank You.

Dina, you really should turn the matter of the will over to an attorney who represents the estate, and consult a referral separately for you and brother to place you guys somewhere that has a continuum of care.

I would appoint a lawyer to serve as executor to protect you before they get their own lawyer to say that a person with Alzheimer’s should not be overseeing the process.

I agree with JoAnn. If you are the executor but also have, as you tell us, Alzheimer's you will need a co-executor or an attorney to hand the distribution of the estate. This would be far too difficult to handle with any impairment of this kind.
Go to a Trust and Estate Attorney with your own diagnosis, with the papers appointing you executor and find out firstly how to get a co-executor or acting Fiduciary appointed to help you work out the distribution of the estate. There will be a fee for this. As long as there is some wealth there it pays to get this done legally and correctly by an attorney.
Best out to you. Remember, you do not have to act as executor. You can resign this position and ask that another be appointed to the job. That may be your brother if he is trusted. Or you can hire an attorney to do the work.

I have an attorney Thank you ! My one brother threatened me .My other one wanted my mom's money I had in account .I probated bank account . I had become afraid and hired an attorney right before my mother died .What a mess this is . I mean truly. I have 5 brothers .one is disabled I have been taking care of him for 25 years. I told the attorney I fall under disability act ,i believe it was in the 60's . I have been called a liar , mentally ill , Alzheimer's ...Just like they called my mother. Oh a thief also

Maybe brother should take over the Executorship. Family having money should have nothing to do with Moms Will. You make sure all debts are paid, get an accting that everyone signs and then split the inheritance the way Mom wrote it in the Will. If you are having problems with family, put probate in hands of a lawyer.

How does this relate to what you've posted? Not able to make sense of what you've written. Can you please clarify if you're asking a question or offering advice? If you're offering advice you should move this to the Discussions section. I'm sorry for the loss of your mother and the current distress you are having.

This Alabama law is all that I found when I tried to look it up too.

If Dinashop77 is also in Alabama, a similar quick internet search indicates that if there is no valid will, the deceased’s children should inherit (assuming no surviving spouse).
