Can't she just give it to me as a gift?

However, all of Mom's funds must be used for her only.

No. You honestly don't want to risk questions on this. I would not do this. My brother received his stimulus check when he was all but comatose and dying. After he died it was sent to me and I was told "You can deposit this into his accounts if you do it fast". Why would I risk messing with the IRS. I looked up how to return it and I returned it.

That check was part of his estate. There was no need to return it.

the correct answer is YES. She is allowed to give away her stimulus check. It doesn’t count toward her Medicaid eligibility. She can safely give the money away.

If she is on Medicaid in the nursing home, her check could be used by the nursing home to help pay for her care. If the the nursing home received the check, it may have been sent to the nursing home by social security to be used as part of her share of costs.

Nope. That’s not how it works with the stimulus check. The nursing home has no legal right to take the check and use it toward the recipients share of cost. Nor does it count as income or an asset for this year.

She shouldn't be getting any mail at the nursing home. See to it that all her mail is routed to your house.

Also check that they haven't registered to vote there without her consent. That happened to my mother, and I shut that down right away.
