No it can not. However, when the patient is admitted, you must present your original, signed and notarized proxy document. So go get that.

Buffy, it was not the hospital who revoked it. It was a judge in surrogate's court. Sorry you are going through this. You need a good lawyer to enter a defense.

Pamstegma -- Thanks for mentioning "notarized" as a necessary condition for a healthcare proxy. I am 85. I recently started sorting through my legal documents and noticed that I hadn't updated the address of my healthcare proxy. I will prepare a new one.

Yes, a DPOA must be notarized. As well, the elder must present a VALID, IN DATE photo ID.
