My mom fell & went to a rehab facility. After a couple of months, she was not improving as much as they thought & Medicare stopped paying. I applied for Medicaid, have provided all the documentation requested & now we are awaiting a Fair Trial. The facility is now saying I have to find another place for my mom because they have only been receiving her social security. My mom is 94. Can the facility throw my mom out even though Medicaid is still pending & we are doing all we have been told to do?

"only receiving her social security" so I take it there is other income? ALL her income goes to the NH. SS, pensions, dividends, whatever she gets goes to the nursing home. If she holds back any money, they can and they will serve a 30 day notice of eviction. I am an ombudsman and I have seen it done. Totally legal.

Do you mean you were denied Medicaid for her and are waiting for a Fair Hearing on the denial? That could take months. What were the reasons for the denial?
