Madge, I'd like to offer a different opinion on the nominal $1 bequest. Our attorney told us about an in terrorem clause, by which individual heirs can be specifically disinherited if the will is challenged. It's a method of pre-empting potential conflicts and challenges by heirs.

Sometimes the testator/trix can include a clause accompanying the in terrorem clause providing a nominal $1.00 bequest to specific heirs.

I would think that these types of clauses aren't typically included in "homemade" wills unless the testator/trix is an attorney. I rather doubt that nonlegal people who do their own wills would be familiar with this type of limitation.

Even though I'd worked in estate planning law firms periodically over the years, I had never become familiar with this concept until our attorney told us about the concept.

Your brother may be POA with ability to sell the house if in fact your dad gave him that power but it is your dad's will that will determine how his estate is divided among his heirs once he has passed

I just read your question again; you mention your dad's will. Has your father passed away? A will doesn't come into question until the person who wrote it dies. In reality, if your dad needs full time care in a nursing home, there isn't likely to be any money left, unless his home is a very high end one.

I assume that the house is being sold so that those monies can be used to pay for dad's care.

Why would you work 24/7 for 60$ per month? Did you have a caregining contract?
