Elder care lawyer may delay grandma's discharge from rehab over guardianship. What do you think?

I'm still dealing with an elder care lawyer to gain guardianship to handle my grandmother's finances when she gets out. Upon talking to them last week they want to delay her discharge while they are getting two doctors to testify that she is non compliant to do anything due to her condition. They have one on board but another hasn't done it ever, hence they will find another doctor to visit and get some background before going to the court. If that's the case that gives me more time to work on the house but what the lawyer told me makes sense. What do you all think are they right or not??!!

Well, as they say, rules is rules. Your attorney needs to abide by them. If he/she needs to wait for the other doctor to sign off on Grandma’s guardianship, then you just need to wait. Now, the only caveat is if Grandma’s Insurance will run out. Then, you need to maybe give the attorney and the doctors a little push and tell them “time is of the essence”.

The rehab gave two options either she goes home and has a 24/7 in house caregiver or a assisted living facility as of now its gonna be the in house when she gets released but it can be changed to a facility. I know of three around the area that she's in. I mean yea this situation is rough enough but we all gotta deal with it.

That makes perfect sense when its time for payments to come in I'm not 100% certain she can put her name on anything if they were to release her now I'm all for siding with the lawyer on that one. But I'm working on this like crazy because I def want to get that resolved

Is Grandma coming back to her home? Should she maybe go to a facility? What do they think at the hospital? I was just thinking that while she’s in the hospital you might want to consider a facility for her. Will you be her caregiver when she’s discharged? I think that would be very hard on you since Grandma is the way she is.

It all has to do with Medicare. There has to be a good reason to keep her in the hospital and rehab or the money will stop. Sounds like the lawyer doesn't understand Medicare or insurances in general. Hospitals don't keep patients any longer than insurances allow.

It seems like the week after next she will be discharged that's why I was wondering if lawyers do anything about it this is all new to me
