It’s going to be State dependent if it’s a smallish personal care home. It’s probably not going to involved Federal oversight as the sm places do not have requirements for professional health care staff that themselves have licensing regulated by State &/or Feds. So no licensed staff then no billing to health insurance (like Medicare) as no payments by health insurance companies for procedures done. It going to be all personal care; the residents are paying for room & board. Some States are very hands off on regulations on small personal care homes if it’s below a set #.

Like Tx has it if it’s 3 or less unrelated individuals in a home, with the property owner or someone in place of the property owner on site, to operate a personal care home you just need for each to have their own bed in a room not used for other purposes (no bed in kitchen or in a congregate living area) and have basic fire safety & health code regulation’s done to be operating. Don’t need to have a RN or CNA or other credential health care provider employed. Literally you could have 3 married couples in 3 double beds in a private home and run it as a personal care home and be within what’s allowed. It’s pretty wild…

If a place accepts Medicare, as they are billing some services to Medicare, then there would be Federal oversight on staffing requirements.

If this question is more about a concern that you have regarding a family member does not seem to be able to get the level of care that you think they need…… the way be in a place that has all kinds of staff is for them to be in a skilled nursing care facility aka a Nursing Home. Cost could be triple or more than what they pay in a personal care home.

Are you talking about privately owned care homes run by the person who owns the home? Maybe they have 5 or 6 residents? I think 5 or more these places have to be licensed by the State. They have to meet certain criteria. If you feel there are health code violations you can call Adult protection Services to investigate. The Health Dept.

There are federal laws as pertaining to facilities that accept federal funding of any kind and there are state laws. These latter vary state to state. I would do your research online with typing in "Federal Laws pertaining to elder care facilties", and the same for your state. This is much better researched according to "issue involved" such as "Notification of injury laws for elder care facilities".
