We have a form signed by the doctor that says "unfit to care for self. " Now it seems that they may be allowed to go home. We have POA, but NH social worker stated to husband that she has to honor their wishes or the "agencies watching the case might report her and the NH ". FIL has been insisting on going back to the house to check on things. The house goes on auction block July 10.  My husband told the social worker that it is against is wishes and once they are in the house there is no way they'll leave and get back into the NH van to return to NH. My FIL threatened to call a lawyer or the police because he was a prisoner in that " h*ll hole". He has a cell phone, beginning to think he did. We can't get a straight story from him, he lies about everything. I know this sounds crazy, but these people ( FIL and MIl ) are the worst!

My husband has told her that if they refuse to return he is doing so. And having name removed from trust as there is nothing but debt to time share to inherit

I would tell the social worker that you are resigning poa and will not be responsible for their safety.
