Before both parents became ill, they created living wills, durable power of attorney and the medical one. Mom has a small life insurance policy I've been keeping up on payments for, so I don't get stuck in the hole like dad did for end of life and funeral costs. He was the only beneficiary on it I contacted policy holder and they would not let me put myself down as beneficiary I sent all legal documents and dad’s death certificate to the company, and they still won't let me change the beneficiary from dad to me, so I have the money to take care of all the financial stuff when she passes. I'm disabled myself and on limited income and am the only one financially to take care of her none of other siblings helped financially or physically with mom or dad, so I'm going to need that money to pay for all the final funeral expenses after she is gone. The insurance company won't let me make myself the beneficiary instead of dad but yet I've been paying the bill every month for last 2 years since dad passed just for that reason. What can I do? I need to be the beneficiary. What forms do I need to complete and serve the insurance company to make me the beneficiary of the policy?

Yeh, looks like the other post was deleted.

Its very hard to change beneficiaries. This has to be done by Mom if she is competent, is she? if not did you prove with a Drs letter that she is not competent to change beneficiaries. I had a problem with one insurance company because they did not except POAs. I had to get a Medallon from my bank.

I found this according to if the beneficiary is deceased.

"If there are no contingent beneficiaries, then the death benefit will most likely be paid directly into your estate. If this happens, then the full amount of the policy’s death benefit will go through a probate court, where it is open to public scrutiny and can be seized by creditors. If you have outstanding debts, such as back taxes, a mortgage or student loans, the Internal Revenue Service or other lending institutions may try to recoup their money by placing a claim on your estate."

Also, unless the insurance policy is targeted for funeral expenses, the beneficiary does not have to use the money for the principles bills. Its their money to use as they wish.
