Should they be taking cash for their services from the client? The client is a 97 year old woman who is still living in her own home and pays her own bills. She has been giving the guardian $100, $200 in cash in an envelope. Is the guardian allowed to accept this, and who is paying her?

I am my sister's Guardian, I am NOT allowed to be paid. My sister does give me a small gift at Christmas, an item her staff buys and costs less than $10. You should alert the surrogate's court that this is happening, because it should show up on the annual financial report and if this is an ongoing "gift" on a regular interval, it represents a serious conflict of interest. Put your deposition in writing with dates and what you saw happen. Sign it and send it to the court.
