I usually work with agencies when hiring caregivers. My new community does not have many of these, so I have had to hire privately.
Written agreements are great. I made a list of all the types of services my Mom needs and ask if there is anything on the list that they would rather not do.
I would also have a statement that removes you from liability if one claims injury on the job.
If you are concerned about the wording, have an attorney look it over. If you are hiring someone for continual employment, you will become the "employer" and have to report wages paid. See this publication at IRS.gov: Publication 926, Household Employer's Tax Guide
