I'm wondering if a medical person place my father in a nursing home without my consent even though I have POA?

Its been over a week and OP has not been back. Hopefully, they found out their answer.

I would say its Rehab and if Dad is competent, he could make that decision. No need for a POA.

You have left out so much information!

Yes, a medical person, like a doctor can have a hospital patient transferred to a skilled nursing facility for continued care that the hospital won't provide.

If you have POA, or are the person's medical representative, you can remove them from the nursing home and make other arrangements for their care.

If a "medical person" did place your father in a nursing home, were you contacted? Did they know you have POA? If you did not consent, did you have another plan for your father's care? Did you speak up and inform the doctor of your alternate plan?

Has the state taken over guardianship because the elderly parent was deemed incompetent and their home was uninhabitable? Do they know you have POA?

If you do have POA, you have to take charge! Take responsibility and take action! You can not simply do nothing if the parent requires care and is incapable of caring for themself.

Placement by a medical person to a nursing home was likely done because the patient could no longer stay where they were. And unless you came along to suggest an alternative, that was the most suitable transfer for the patient's safety that any medical personnel could authorize.

No a hospital cannot move anyone to a skilled nursing unless the person or poa gave permission. If they did this with no permission it's illegal as hell it's called DUMPING. Reason being if that person can't give permission to treat or understand what they are signing or saying yes to the hospital is in deep dog do. It is the hospitals responsibility to care for this person regardless of cost, until family, a poa or court order. If this happened contact department of public health, please make a complaint as this happens more ofter than we think.

Do you have health care Proxy to make medical decisions with the Doctor for your Dad . They are easy to sign - all you need are 2 witnesses and can be done at the bank . Then you present what ever Doctor Placed him in a NH and ask " Why ? " You should Have been consulted. Get the healthcare Proxy on file with His Doctor and this NH .

Is your dad incompetent? Your POA can be overrided by your dad himself. He may have agreed to the transfer for skilled care. Doctor cannot place for long term care as Medicare doesn’t cover it

Perhaps the doctor sent your father to a Skilled Nursing facility for short term rehab purposes after a hospital stay so he could get back on his feet? Which is a whole different kettle of fish than "a medical person placing father in a nursing home w/o your consent" for long term care. Hopefully you are not jumping to conclusions since no medical person has the authority, or access to private financial info, to place an elder in long term care permanently

I agree we need more info for context.

Unless your parent told the medical person that he has a PoA and how to contact you, they would have no way of knowing. I've had to submit my PoA paperwork preemptively, everywhere my Mom gets medical care. When my Aunt landed in the ER I went there with PoA paperwork, otherwise they'd have no way of knowing. You will now need to go to the Nursing Home with the paperwork.

I think we need to hear more about this situation.
Generally a POA is consulted.
However, if a medical person believes someone is UNSAFE, they are mandated reporters to APS, and etc.

Do tell us what has happened in your personal situation and we can perhaps be of help in giving you some ideas.
