What are the chances of getting guardianship of my mom? She lives in another state, and has been stuck in a very bad nursing home by her 30 year younger husband, he is just waiting for her to die. There is no estate , I just want her to receive the best care she can. He will not even allow another Dr to see her. I am appearing in court DEC 3rd. what are my chances.

We are all pulling for you. The court can ask for an independant evaluation of her and her condition. As a precaution remember that the more factual information you can give them the better,

Essentially you should be able to put enough factual information in their hands on the court date to cause them to ask for an evaluation. How is your mom's mental status - can she speak for herself?

i hope your chances will win the case . once the judge finds out he is 30 yrs younger than your mother he may be raisin some eyebrows ,

i know a bad nursing home in fla . it was a errie feelin to be in that place , hated it , my brother was talkin about puttin dad there i freaked out sai doh no no ure not ! so he is here indiana with me in my home , safe and sound and with love too ....

If your mother is legally married (God help her) to this guy, thirty years her junior, the court will probably honor his wishes about her care. You have to take HIM to court and show cause why he should be removed as guardian. This is a lot of work and usually does not work out. The best you can hope for is to ask him to remove her to a different nursing home.
Isn't mariage just a date that worked out? ( Dennis Miller, Fox News 2008).

cr was suppose to have court yesterday , havent heard what the result was from the judge , am hoping it all works out for the best , ..

The judge ruled in his favor , and would not even order a independent medical examine. Any sugesstions for future actions?

Try to go as much as you can and make it known she ahs someone who cares & and THERE. Make friends with the staff - - even if it an abysmal place, you can make all the difference for her.

You can always revisit the issue later. If the husband doesn't visit and essentially abandons her, the ombudsman and staff will tell you and may help. It sure is sad that you have had to go through this.
