Im wanting to be my father's financial POA and also wanting to take care of him in his home. Will I be able to be paid by an in home care facility or does my father have to pay me out of his pocket?

Any care contract should be done by an attorney, and can be done only if your Dad is competent. I would see an elder law attorney with your Dad to discuss either shared living expenses or financial arrangements. Whatever decisions and contracts are done you will need to keep careful records, file taxes as needed, and etc.

I guess your talking about those agencies that pay family members to care for a LO. I see no reason why you can't be paid by an agency and be POA too. But, I don't think you can be POA and get paid by Dad to care for him. It maybe considered a conflict of interest.

If you are not Dads POA at this point and he is considered competent, this is a question for the lawyer drawing up the POAs.

Is his cancer terminal? If so and he is not already on Hospice, you may want to get them in. You will get an aide for bathing. A member was able to get the aide for extended time to give herva break.

If a care contract is in place it should not be a conflict of interest.

Are you currently his PoA? If not, this needs to be done by him before he becomes incapacitated.

You could be some payment through Medicaid (if and when he qualifies) but it is usually never for full-time and is minimum wage. Otherwise, he will need to pay you. There should be an employment contract so that what he pays you doesn't appear as gifting, thus delaying or disqualifying him.

As his PoA you need to keep very meticulous records.
