My brother used our parents' monies from the sale of their home to purchase his home. Now my parents (71 and 79 yrs old) are being kicked out of my brother's home. Is there anything my parents can do to recuperate some of that money? My parents will be out in the street. What can they do?

Was there an agreement made up that to care for ur parents a bigger house would need to be purchased and to do that the sale of their house would be used to offset the cost of the new one? Are parents on the deed?

Why does brother feel he doesn't want Mom and Dad anymore. There must be some conflict. Yes, first I would call APS and run this by them. In this climate brother may not be able to evict. Your parents may need to consult with a lawyer concerning the use of their money in buying brothers house.

Parents will not be out on the street they have you and at least their SS checks. There is HUD apartments and where I live they are not bad. Low income apts too. If parents meet the criteria, there is Medicaid for supplimental health insurance. Your local Social Service dept should be able to help with resources.

How long ago did he use folks money for his home? I would definitely report to APS and get an attorney. If folks were to get on Medicaid they would see the gift to bro and REFUSE coverage for folks until those funds are repaid.

This can't be true , can it? If it is, I suppose I would contact APS. Or if you'd like, hire a lawyer to fight for your parents.

They have tenants rights whether or not there is a written agreement and whether or not they pay rent. He cannot just kick them out, if they won’t leave on their own then he has to formally evict which is likely not possible right now. No one can tell you if they can recoup the money, we don’t know what the agreement was, if any. They will likely need an attorney.
