Another person is living in the home and makes monthly mortgage payments to the individual applying for Medicaid.

Elindsey, is the Medicaid applying person a "landlord"? Thus, it is the rent that is being given, not a mortgage payment? Or is this a "rent to own" situation? If yes, then does the whole "rent" go toward the down-payment on the house or just a certain percentage? For income tax reasons, is this property a profit or a loss?

Each State handles their own Medicaid rules, regulations, and programs. This is something that needs to be talked over with with Medicaid.

you may need legal advice on this. I know in PA, the Medicaid recipient can get help and nothing changes while they are living. once that individual passes, estate recovery comes into play. there are various circumstances that could possibly protect the "renting" individual. I am in the situation with my dad - he is living with us instead of a nursing home because we are trying to honor his wishes

She is holding the mortgage which means the house has been sold. She doesn't actually own it.

This is really an usual circumstance and you need to talk to a lawyer versed in Medicaid.
