My father recently suffered a stroke. He will be going to a nursing home and not returning to his home. The E.M.T.'S that were there on the 911 call would like to charge my brother with elder abuse. Can they still charge him even though he is not in the home anymore?

I'm sure a person can be charged with a crime that happened in the past, even if it is not continuing in the present.
