Mom has a will stating her house is to be sold after her death. The money is to be dispersed equally among her adult children. My brother was awarded legal guardianship over mom 2 months ago, and now wants to sell her house. Can he do this?
If the guardianship papers give him legal control of her assets as well as the ability to dispose of those assets then yes...he may need to sell the home to pay for her care and this is perfectly legal (and ethical). Your mom may have intended for her kids to receive an inheritance, but first and foremost her assets are for her care...and what's left goes to the kids.
