my uncle is her guardian now but he has his best interest at heart not his poor confused mom He uses this authority for his own gain with no fear of leagal recourse from the siblings I want to be her guardian I love her and fear she is a burden to him scared she is being abused

If he is her LEGAL guardian through the courts, if that's what you mean, you need to consult an attorney. You'll need to have your concerns documented, maybe journaled, and some kind of proof and/or witnessing would be helpful. This could get costly, but most attorneys will give you a short free consultation. Have your paperwork in order so you can briefly in to simply explaining the problem.

Definately need an attorney in this matter and take him your proof. It would have to go to court in front of a judge. I am presently getting guardianship over my wife that recently went into a Nursing Home in bad shape. Court fees and attorney fees totaled $675.00 for me here in Saginaw, Michigan. Might be different in your area.

In order to be her guardian, you need to be 21, have a complete background and credit check, then all other possible guardians must sign off and agree you are the right person. You would need concrete proof and testimony of the abuse to get him removed.

Make an appointment with an ESTATE ATTORNEY PRACTICING ELDERLY LAW. At the time you make the appointment ask the Aid what you should bring to the first visit.
