Jane Novick established her law office and LLC in 2012. Jane is the sole attorney. Her law practice concentrates on the following areas: Disability law, Elder law (including Elder Abuse), Estate Planning, and Juvenile law. Because many of Jane’s clients have a disability, have a child with a disability, or are elderly, Jane will meet with the client at their home or at a place that is convenient for the client.
1. Disability Law
The Law Office of Jane Novick, LLC works with both individuals with special needs and/or their families. She can help them with the following issues:
• Special Needs Trusts
• Guardianships, Powers of Attorney, and Advanced Directives
• School issues, such as: IEPS, assessments, communicating with school officials, Due Process, restraint and seclusion issues
• Employment discrimination
• Social Security
As a parent of an adult child with a disability, Jane is well aware of the difficulties that an individual with special needs experiences in attempting to protect his or her rights. Jane will come to your home or place of your choice. She can help you navigate the complex and time-consuming process of Social Security and Medicaid. School-related issues concerning a child with special needs can be challenging and stressful, and Jane can act as a facilitator between the school personnel and the parent. Her knowledge of special education law can help parents and school personnel to craft an Individual Education Plan (IEP) that takes advantage of the law (IDEA) to provide the best possible services for the child.
2. Elder Law
The Law Office of Jane Novick, LLC works with the elderly. Some of the issues her practice handles include, but are not limited to:
• Elder Abuse, Neglect, or Financial Exploitation
• Educating the elderly on their legal rights and how to protect themselves from fraud and scams.
• Estate planning
• Guardianships or Conservatorships
Sadly, there are many issues concerning elder abuse. Jane works closely with Adult Protective Services to help the elderly that are subjected to abuse, neglect or financial exploitation. She may help identify a suitable person to be the person’s Guardian. If this is not needed, Jane can create a General Durable Power of Attorney in which the elderly person appoints an agent to help take care of the person’s financial matters. She also works with the elderly to educate them on ways to protect themselves from abuse, neglect, or financial exploitation. Jane is happy to speak to groups on ways people can protect themselves.
3. Juvenile Law
A third area of law handled by The Law Office of Jane Novick, LLC is Juvenile law. This includes:
• Guardian ad Litem
• Criminal Defense
4. Estate Planning
The Law Office of Jane Novick, LLC does estate planning. This allows the individual to decide how their assets will be distributed upon their death. In general, when there is no Will, the Probate Court, using the Ohio Revised Code, will determine how the decedent’s assets will be distributed. Estate planning is a great tool to establish a support system. Powers of Attorney and Advanced Directives (Healthcare Power of Attorney and Living Wills) allows one to designate one or more agents when the individual is unable to make financial and/or health care related decisions. At times it can be helpful to have someone else pay one’s bills and handle other financial matters. When a General Durable Power of Attorney is established, the individual will designate someone they trust to be their agent. The same is true for Advanced Directives.
Trusts are useful for estate plans. A trust is a legal mechanism by which an individual transfers legal ownership of funds or property to someone else, a trustee. The trustee will maintain and manage that property. Trusts may provide tax, inheritance and/or legal benefits to the individual that created the trust and the beneficiaries.
Jane believes that providing information to groups of people may reduce potential legal problems. Jane is happy to speak to your group. Some possible topics include, but are not limited to:
• Estate Planning: Wills, Trusts, General Durable Power of Attorney and Advanced Directives
• “Thinking outside of the Box”—the importance of making one’s own funeral arrangements
• Guardianships and Powers of Attorney
• Special Education law
• Special Needs Trusts
• How to avoid Financial Exploitation
Jane is determined to help people protect their legal rights. If cost is a problem she will work closely with you to try and find an affordable solution.
