I am my both my parents power of attorneys. I never intended for my mom to be excluded. How can I include her?

Both the nursing home and health insurance company have HIPAA forms you can fill out for your father and sign as POA listing yourself and your Mother as people to whom information can be released. I am my mothers POA and any time she is admitted to the hospital or goes to a new doctor I fill out new forms and list all my siblings so whoever is there with her can get information. I am poa for both parents. My notary did two forms, one making my mom and then me POA over my step-dad who has dementia, and one with me poa over my mom. hope it helps

I don't think you can do anything about it. The POA was your father's to assign. It is not yours to reassign. If your father is still able to comprehend the concept of POA and is competent in the legal sense to sign documents, he could sign a new document, but if that is not the case, it cannot be changed.

You can, of course, relay all the information you get from insurance and the NH, etc. immediately to your mother. And you can assure her it was not the original intention to exclude her. You can let her make decisions that you then act upon. But officially, you are the POA.

Talk with an Elder Law Attorney. You may be able, as the POA of your Dad, to authorize in writing for the medical facilities to also share all information with your mother but you still retain the POA which is likely what you really want to accomplish.
