It'sillegal to restrain resident's. If they have a seat belt on try to get up, they don't just fall. They fall with the wheelchair on top of them.

Think it's up to the nursing home to use their discretion, because my mom fell down trying to get up from her wheelchair. She kept insisting she could walk. They called me and told me she had to be belted in her chair until she stopped trying to get up from chair by herself. I told them that was ok because of her safety. Now I don't know if the nursing home follows certain Federal guidelines, but I do know they are looking out for their patients safety.
