How do I go about obtaining durable POA and medical POA? We cannot afford lawyer's fees.

I wonder if by activated they mean she has not been declared incompotant. My aunts poa will never go into effect unless 2 doctors declare her mentaly incapacitated.

I am not sure what they mean by "activated." Please have them explain what that means. It could be that your state has special requirements for filing. You may have to have something notarized, witnessed, or they may want an additional form. If your attorney prepared these documents, he or she should know what they need. Since you paid for their work, they should straighten this out for you.

HOW DO I legally become my mother"s POA for healthcare and finacines, We have the paperwk from the lawyer, but everytime she goes to a NH for rehab. They say it is not activated. How can we get this activated. I am a registered nurse , wk a job and take care of my mother. We did do hv alot of money 4 lawyer fee"s.

My aunt contacted her Dr. office who mailed her the forms. She filled them out then we went down to the bank and a notary there had it notarized. That was for the medical poa.

This isn't for everyone, but I created both POAs online. If you do not have a problem with forms and following directions, it really is not that difficult. I used a website called, "Legacy Writers" because it was easy and their state forms are up-to-date (VERY important). Each state has different requirements for filing, etc. The other thing I liked is that they store the docs so you can make additional copies, which I highly recommend, because doctors and hospitals will want their own and I keep a copy with me. Make sure the extra copies are "official"...for example, if notarizing is necessary, make several notarized copies. There are several other sites that offer this service, but this is the only one I have ever used.
