My father is living with us and was diagnosed with a neurological issue that affects his balance. There is a possibility he will need assisted living. We applied for Medicaid, but he is living in our home. Will our income affect his Medicaid application?

In Massachusetts there is a law that saves a home from Medicaid. If you lives in a parents home and care for your parent. You need to show you have lived there for 2 years. The best way is to have a child register in the district where they live with the parent and vote. When the parent needs nursing home care. The nursing home will check off the home as Medicare except.

What if you own your own home & an adult child moves in with you to care for you and spouse? Can they be added to the title & not have it (house) TAKEN AWAY FROM THEM IN EVENT OF PARENTS DEATH?

Here in NY, Life Estates create a problem, because if the house is sold, the Life Tenant must receive a portion of the proceeds based on a schedule for life expectancy. For example, my 86 yr old MIL would get 1/3. In 2011 the NYS Legislature declared open season on Trusts for MERP in NY.
