Mom is been in a nursing home with Alzheimer's for almost 2 years we have live together for 5. I am her primary caregiver for all her doctor's appointments and all her needs I live in the home that she has a lifetime estate on and I am on the deed. The home is also left to me in her will. My mother's guardian of her State wants me to pay rent. I am a single mother of two and cannot afford that. If I am forced to leave the home I will have to move out of state to live with friends and there will be no one around to help take care of my mother's needs. Is there anything I can do.

My question is kind of complex, but my mother was in the hospital, and was discharged to a retirement community for therapy to recover her strength. The home doesn't offer therapy, but were willing to take Mom on the 30 request from the hospital and have a therapist come in. A therapist came and evaluated my Mom and said she does not need therapy. The doctor said she could return home but needed 24/7 care just to make sure she doesn't fall. After my sister who is the POA searched she couldn't find this care for anything less than almost 4 times my Mom's complete monthly payment. I found a very competent care giver with years of experience, certified, and bonded. I have known her for years and years. She is doing care giving on her own now, and she said as a favor to my husband and I she will stay with Mom 24/7 7 days a week if I give her a break on Sundays for what Mom is paid. Problem being, if she goes home and has to pay all her check for care the dr. ordered, she has no money for any expenses, groceries, electric, etc. Is there any financial help for her so she can meet her bills. I won't find anyone anywhere that is willing to stay with Mom with all these hours, for the amount she is willing to accept. We need help asap. Thank you.

Need to know how to get spouse into possible memory care facility while I am still living in our condo that has a mortgage and a condo fee and how it gets paid for? We have medical insurance, Medicare, etc.

My mom doesn't own a house or anything like that. She had a stroke recently this past Friday. She was in a hospital, now in a nursing home. I need to pay her by this Tuseday if I don't get the rent for her when she gets better she'll comeback with no home to comeback to I can't get into my mom's account to pay for her rent and I can't get access to my so I can get food for me and things like because my mom is the holder of the bank account and still have under miner which is something it should of been changed a long time ago before something would happen. I tried talking with my mom about this at hospital and nursing home. She has what slurpy speech. And she thinks. Well my brother help's me a little because I am totally disabled and my mom thinks she can still help me with things. But not in the condition that she is in. I need I need legal help for someone before it's too late. My mom will be evicted soon. Tuseday the property manager will file an eviction and the manager can't be reason with. There is a word for why she wouldn't have a change of heart for that kind circumstances. But please help me fast. If I don't get help fast when my mom returns she will find her self evicted and most likely have a heart attack. Any help please ? I'm desperate. If something happens to my mom I wont be able to live with my self. Because it's more than that it's this crooked manager trying to illegally evict me or anyone else she wants to do that to. Please I'm begging. Someone help god I'll do anything. Save my mom.

The residential property is only excluded if the Nursing Home resident is coming back home or there is a spouse or dependent living in the house in determine eligibility for Medicaid application for Nursing Home resident.

Many times the home of a senior in that type of situation has a home in need of MUCH repair; i.e., outdated wiring, termites, mold, leaky roofing, drippy plumbing, overgrown yard, broken fencing, cracks in foundation, etc. The home may be in a prime location but... there may be a few angry neighbors with plans.

i know of a situation where a son and daughter live with the mom. they r 54 and 55, They all on the P O A. with the youngest girl first..Is she allowed to do all the dictating. if they put her in a nursing home , will they loose the house

Unless the patient is truly impoverished, an attorney who is proficient in elder law should be consulted before applying for Medicaid. The law was changed several years ago. If assets have changed hands and you apply for Medicaid before the 5 year lookback period is up, you can be penalized and it can take even longer before the patient is eligible for Medicaid. Medicaid rules are not the same in all states either, so make certain you deal with someone who knows about the correct state.

As the attorney stated....for six months if it is thought he may return an allotment will be made for the mortgage from his funds. The disabled son should have income from disability ss & be able to pay some of the expense. Check with social services, area agency on aging...etc. you should be able to find help. Google your questions on the web....you will find a plethera of info.

Dad (86yrs) with severe vertigo needs nursing home care now-Still paying mortgage on Mobile home along with all utilities etc. Even if he consented to sell-with the current market it could take a year or longer-No one in family able to afford to continue paying these bills-so will we have to just walk away from it and let the bank have it? His disabled 50 yr old son lives there with him and essentially will become homeless--Can anyone help us. Our State is Massachusetts

I would hire an elder lawyer in your state and charge the fee to her and take his advice which you will need to do anyway because a nursing home will insist that you apply for medicaide but make sure the social worker and the lawyer help you it is very complicated and if her assests are too much she will have to spend her money down for care until she is at the level allowed to get medicaide her assests will probably be too high at first because they count any life insurance and pension she has as an assest -you are allowed to prepay for the funeral expenses with her money but in my state if you are married the debts can not be subtracted from the assests and the well spouses life insurance is considered an assest that is why you need legal advice up front because even though you-the well spouse can keep the home and it is good to have it in trust to an adult child-but there is a look back period of at least 5 years and you have to account for any large amounts of money withdrawn the last 5 years and have to get 3 yrs. of bank statement and anything over 2 thousand

Would the fed. rule permit the deduct for an apartment rental for the six months?? Mom sold her house years ago but pays for her apartment now. Would that rule apply?
